Legal role · When is it required?

Three Most Common Cases
That Need a Judicial Record Certificate

Under the Judicial Record Law 2009 (amended 2025), a judicial record certificate verifies whether an individual has any criminal record and whether they are prohibited from holding office, founding, or managing a company — a mandatory document for many administrative, judicial, and international procedures.

01
Individual
Job Applications & Civil Service Exams
Certificate No.1 is often required for government jobs, foreign-invested enterprises, and financial institutions — confirming the applicant has no uncancelled criminal record. It is mandatory for public service recruitment.
02
International
Exit, Study Abroad, Immigration
Certificate No.2 is usually required for immigration visas, family sponsorship, foreign-related marriage, and work permits. Many embassies require the certificate to be issued within 3–6 months of submission.
03
Business
Company Formation & Business Licensing
Legal representatives and capital-contributing members of certain conditional business sectors must submit Certificate No.1, confirming they are not prohibited from founding or managing a company under the Enterprise Law and Bankruptcy Law.
"A judicial record certificate is not just a procedure — it is the legal document that confirms citizenship status and protects an individual's legal rights in every important transaction."

Distinguishing Certificate No.1 and No.2

How Judicial Record Certificates
No.1 and No.2 Differ

The two certificate types differ in recorded content, eligible recipients, and intended use — they are not interchangeable. Choosing the wrong type means redoing the application, costing extra time and money.

①
Judicial Record Certificate No.1
Common — for individuals
—Recorded content: Only records criminal convictions that have not been expunged under the law. If the conviction has been expunged, the certificate states "No criminal record" — legally treated as never convicted.
—Who can request it: Individuals (Vietnamese citizens or foreigners currently/previously resident in Vietnam). Can authorize by written power of attorney; parents, spouses, or adult children may apply on behalf without a power of attorney.
—Used for: Job applications, civil service exams, business registration, company formation, domestic administrative procedures, and some foreign-related civil matters.
—Format: Paper or electronic certificate with digital signature — legally equivalent under the 2025 amended law (effective 01/07/2026). Information also appears on the VNeID app once issued.
—Validity note: The law does not set a general validity period. However, each sector has its own requirement: citizenship applications usually within 90 days; adoption and bailiff procedures within 6 months from submission.
②
Judicial Record Certificate No.2
Specialized — higher confidentiality
—Recorded content: Records all criminal convictions, including those that have been expunged under the law — more detailed and comprehensive than Certificate No.1.
—Who can request it: Judicial authorities (investigation, prosecution, trial) and individuals requesting their full criminal history. Power of attorney is not allowed — the applicant must handle the procedure personally.
—Used for: Investigation, prosecution, trial; immigration visas to some countries; foreign-related marriage; naturalization; overseas labor markets requiring a full criminal history.
—Usage period: Bailiff procedures require the certificate to be no older than 6 months. Embassy applications often require 3–6 months from the submission date — check the specific receiving agency requirements.
—Confidentiality: Issued only to those with a genuine need. Certificate No.2 is protected under the Judicial Record Law and is not as widely distributed as Certificate No.1.

Where to Submit &
What to Prepare

From 01/03/2025, under Decree 02/2025/ND-CP, authority for judicial record certificates moved from the Department of Justice to the Ministry of Public Security (provincial/city police). The declaration form also changed — use the correct new form to avoid returned applications.

Step 1
Identify where to submit
Vietnamese citizens submit at the provincial/city police where they have permanent or temporary residence. Those who cannot determine a residence location submit at the Ministry of Public Security Record Office.
Step 2
Prepare your documents
Complete the declaration using Form 03/2024/TT-BCA (download from the National Public Service Portal or the provincial police website). Include a copy of a valid ID card/passport. Provide a power of attorney if needed (only for Certificate No.1).
Step 3 · Submit & pay
Submit application & pay fees
Submit in person at the provincial police one-stop service desk, by postal service, or online via the Ministry of Public Security portal / VNeID app. Pay the prescribed fee.
Step 4
Track status & receive results
Track the application status on the Ministry of Public Security portal. Receive the paper result by mail or in person, or download the electronic PDF with digital signature from the system.
Processing time: Normally 10 working days from receipt of a complete valid application. If additional verification is required (multiple residences, foreign residence, foreign nationals, expungement verification): up to 15 working days. Online submission via VNeID (pilot): may take only 3 working days.
Submission channels
In person at provincial police The one-stop service counter at the provincial/city police where you reside. Suitable for all applicants.
By postal service Send documents and receive paper results through the postal service. Suitable when you cannot appear in person.
Online — Ministry of Public Security portal Log in with a level-2 digital identity account. Receive an electronic result (digitally signed PDF). 15% fee reduction until 31/12/2025.
VNeID app Pilot launched on 01/10/2024. Electronic certificates appear on VNeID and are legally equal to paper certificates under the 2025 amended law.

Frequently Asked
Questions

Common issues clients face when preparing judicial record applications under the new 2025 regulations.

Ask for advice →
Q1 Where should I submit a judicial record application after March 2025? +

From 01/03/2025, under Decree 02/2025/ND-CP, authority to receive and issue judicial record certificates transferred from the Department of Justice to provincial/city police. Submit at the one-stop service counter of the police where you have permanent or temporary residence. If you cannot determine a residence location, submit at the Ministry of Public Security Record Office. Note: do not submit at the Department of Justice — this is the most common source of confusion.

Q2 Do I need Certificate No.1 or No.2 for a job application / overseas travel? +

It depends on the purpose: domestic job applications, civil service exams, or company formation typically require Certificate No.1. Immigration, family sponsorship, foreign-related marriage, or work permits for foreign nationals in Vietnam often require Certificate No.2. Important: Certificate No.2 cannot be authorized — the applicant must file in person. If unsure, contact VLIC for free advice before submitting.

Q3 How long does it take to receive a judicial record certificate? +

The standard processing time is 10 working days from receipt of a complete valid application (excluding weekends and holidays). If additional verification is required — multiple residences, foreign residence, foreign nationals, or expungement verification — the maximum time is 15 working days. If submitted through the VNeID app (pilot), it may take only 3 working days.

Q4 How long is a judicial record certificate valid? +

The Judicial Record Law does not set a general validity period. Each procedure has its own requirement: naturalization usually requires the certificate to be no more than 90 days old. Adoption and bailiff procedures require the certificate to be no more than 6 months old. Embassy / immigration visa applications typically require 3–6 months depending on the country. Check the receiving agency’s specific requirement before submitting to avoid reapplying.

Q5 Is the electronic certificate on VNeID accepted the same as the paper version? +

Under the 2025 amended Judicial Record Law (Law 107/2025/QH15, effective 01/07/2026), electronic and paper certificates have equal legal validity. Judicial record information is displayed directly on VNeID — individuals can use it immediately without needing a paper copy. However, some agencies or embassies may still request a paper copy with an official seal. VLIC advises based on the specific receiving agency’s requirements.

Q6 Where do foreign nationals in Vietnam apply for a judicial record certificate? +

Foreign nationals currently residing in Vietnam apply at the police office of the province/city where they live. Foreign nationals who formerly resided in Vietnam but no longer do apply at the Ministry of Public Security Record Office. Required documents include the new declaration form, a valid passport, and residence permit documents. Foreign nationals cannot use VNeID — they must apply in person or by mail. VLIC supports translation and submission on their behalf.
